Eligibility for Asylum & Refugee Status
A person who is present at the frontier of the Irish State (Republic of Ireland) or already within the country may apply for international protection.
Who Can Apply for Asylum?
An individual may submit an application under the following conditions:
- Adults (18 years and over): They can apply for international protection on their own behalf.
- On behalf of a minor (under 18): A responsible adult can apply for a child under their care and protection.
Grounds for Seeking Asylum
You may apply for asylum in Ireland if you fear persecution or serious harm in your home country due to reasons such as:
- Race, religion, or nationality
- Political opinion
- Membership in a particular social group
- Risk of torture, inhumane treatment, or execution
Asylum Applications for Family Members
- Children under 18: Dependent children accompanying an applicant in Ireland will automatically be included in their parent’s application.
- Spouses and adult family members: A spouse or any child over 18 must file a separate asylum application.
Applying for Asylum as a Minor (Under 18)
- If accompanied by an adult relative who is claiming asylum, a minor is typically included in their relative’s application.
- If unaccompanied, a minor should inform an immigration or police officer at the border or visit the International Protection Office (IPO) as soon as possible.
- A social worker will be assigned to determine if an asylum application is in the child’s best interest. Legal assistance will also be provided to support the application.
