Immigration Options After Relationship Breakdown

In the event of a relationship breakdown or other significant change in circumstances, the applicant must notify the Department of Justice (Immigration Service Delivery) within two weeks of the change occurring.

Reporting a Change in Circumstances

The following changes must be reported:

  • Death of the sponsor
  • Sponsor’s departure from the State
  • Divorce or annulment of a civil partnership
  • Breakdown of a de facto relationship

Failure to notify the Department within the required timeframe may impact the applicant’s immigration status.

Death of the British Citizen Sponsor or Divorce from the British Citizen Sponsor

If a spouse, civil partner, or de facto partner has been granted permission to reside in Ireland based on their relationship with a British citizen, specific conditions apply in the event of separation, divorce, or the sponsor’s death.

  • A sponsor who has been joined by a non-EEA spouse, civil partner, or de facto partner will be ineligible to sponsor another non-EEA national spouse or partner for at least seven years following the legal termination of the previous relationship (through separation, divorce, or dissolution of the de facto partnership).
  • This condition also applies to non-EEA nationals who have been residing in Ireland under spousal or partnership status and later seek to sponsor a subsequent non-EEA national spouse, civil partner, or de facto partner.

If the Non-EEA Spouse or Partner Dies

In cases where the non-EEA spouse or partner passes away, the British citizen sponsor may submit a new application for family reunification under applicable immigration schemes.
