
Who Does the Scheme Benefit?
The scheme is designed to assist individuals who have been residing in the State without permission for a significant period. Specifically, it benefits:
- Long-term undocumented residents – Individuals who have lived in the State without permission for at least four years, or three years if they have children.
- Former students with expired permissions – Those who previously held student visas but have since remained in the State unlawfully.
- Individuals with pending deportation orders – Provided they have met the required period of undocumented residence in the State.
Potential Beneficiaries
- Former EU Treaty Rights residents – People who previously had permission to reside based on marriage to an EU national, where such permission was later revoked due to a marriage of convenience ruling.
- Applicants for humanitarian leave or international protection – Including those applying for humanitarian leave under Section 3 of the Immigration Act 1999 and individuals seeking asylum or subsidiary protection.
This scheme provides an opportunity for eligible individuals to regularise their status and obtain legal residence in the State.
