Next Steps After a Successful Judicial Review
If a judicial review application is successful, the court may grant one or more discretionary remedies, depending on the case’s circumstances. These include:
1. Certiorari (Quashing the Decision)
- The court sets aside (quashes) the unlawful decision or action taken by the public authority.
2. Prohibition (Preventing Unlawful Action)
- The court prohibits the public authority from taking an unlawful action in the future.
3. Mandamus (Compelling Action)
- The court orders the public authority to carry out a legal duty it has failed to perform.
4. Damages (Compensation for Losses)
- The court may award damages if it determines that financial compensation is an appropriate additional remedy.
5. Costs (Legal Expenses)
- At the conclusion of the judicial review, the court will decide whether the applicant is entitled to legal costs, based on the circumstances of the case.
