Deadlines for Filing a Judicial Review

Judicial review applications must be made within strict time limits. Recent amendments to court rules specify that proceedings must generally begin within 3 months from the date the grounds for the application first arose.

Time Limits for Judicial Review Applications

  • General Matters: 3 months
  • Immigration Cases: 14 days from the date of the decision
  • Planning Decisions: 8 weeks
  • Awarding of Public Contracts: 30 days

Extending the Time Limit

In exceptional circumstances, the court may extend the deadline if it finds good and sufficient reason to do so. However, delayed applications are typically refused, and even those filed within the deadline may be dismissed if the delay causes or is likely to cause prejudice to a respondent or third party.
