Work Permit Schemes for Skilled Labour
The Atypical Working Scheme (AWS) was introduced by the Department of Justice and Equality in 2013 to provide a streamlined route for short-term work in Ireland. This scheme applies to work that generally falls outside the scope of standard Employment Permits legislation.
It allows non-EEA nationals to undertake temporary work assignments in Ireland lasting 15 to 90 days, offering flexibility for employers and highly skilled workers alike.
Who Can Benefit from the Atypical Working Scheme
The scheme is suitable for situations such as:
A highly skilled worker required to complete a short-term project
Filling a position recognised as a short-term skills shortage
Locum doctors needed on a temporary basis
Researchers who do not qualify for an Employment Permit or Hosting Agreement
Applications under the AWS must be submitted from outside the State (the 26 counties of the Republic of Ireland) directly to the Immigration Service Delivery. Applications from individuals already present in Ireland are not accepted.
Duration, Remuneration, and Eligibility
Permission under the scheme is granted for a minimum of 15 days and a maximum of 90 days. Each person may only submit one AWS application per 12-month period.
The minimum remuneration is based on the National Minimum Wage, and applicants should verify the current rate on the government website before applying, as it may be subject to change – www.gov.ie/en/publication/41a981-the-minimum-wage-in-ireland/.
Roles listed on the Ineligible Occupations List for Employment Permits published by the Department of Business and Enterprise are not eligible under the AWS and will be refused.
Visa Requirements and Approval Letters
Visa-required nationals must obtain an entry visa upon receiving a letter of approval from the Department of Justice and Equality. Non-visa nationals do not need a pre-entry visa but must carry appropriate documentation for presentation to immigration authorities.
Approval letters issued under the AWS are valid for 90 days from the date of issue. There is no extension available, so if the letter is not used within this timeframe, a new application and the non-refundable €250 application fee will be required.
Important Considerations
The Atypical Workers Scheme provides a practical solution for short-term labour needs, helping employers avoid the longer Employment Permit process in qualifying cases.
However, it cannot be used to bypass employment permit legislation, and both employers and employees must ensure full compliance when applying.
